Exemption Letter

The Exemption Letter is an explanation about the need for mandatory product compliance.

Right to Issue Exemption Letter

Only accredited organizations may issue the Exemption Letters for customs clearance, which credentials certified and confirmed by the Federal Agency on Technical Regulation and Metrology of the Russian Federation. Here are the organizations below:

The Kaliningrad Center of Standardization, Metrology and Certification (KCSMC)

Prepare expert opinions for the customs of Russian Federation or trade (based on FCS letter № SP-101-26/969 dated on 16.02.2010) according to the Government Resolution №982 of Russian Federation dated on 01.12.2009, as well as compliance with effective requirements of Technical Regulations (if it is necessary).

All-Russian Scientific and Research Institute for Certification (OJSC VNIIS)

All-Russian Scientific and Research Institute for Standardization and Certification in Mechanical Engineering (VNIINMASH)

Prepare expert opinions exclusively for the motor vehicles.

Types of Exemption Letters

Depending on the purpose of obtaining, the exemption letters classified into 2 types:

• 1. First type submitted to the Federal Customs Service of the Russian Federation when the products clear customs. KCSMC or OJSC VNIIS prepare the exemption letter, which contains a reasoned expert opinion that the product is not subject to the mandatory certification or contains information about the need for mandatory product compliance.

• Second type required for the trade operations. The exemption letter for the trade confirms that the products are not included in the list of products for mandatory certification or confirms information about the need for mandatory product compliance. Only accredited product certification authorities authorized to issue this type of exemption letters.

A period validity for the exemption letter lasts until an authority makes some changes in the documents, which will require the need for mandatory product compliance.

In order to obtain the exemption letters the applicant must submit the following documents:

• Application form for the exemption letter

• Delivery documents for the products (in the case of customs clearance)

• Description of the products
