Certificate of Compliance with the Customs Union

When the Customs Union was established, which includes Russia, Belarus and Kazakhstan, the Russian Certification System required some major corrections. In order to minimize costs and remove the additional barriers for the import and sale of products on the whole territory of the Customs Union, there was introduced the standard form for the Certificate of Compliance and the Declaration of Compliance with the Customs Union.

The Certificate of Compliance with the Customs Union is a document confirming that the manufactured products for sale and purchase in Russia, Belarus and Kazakhstan meet all regulatory requirements that set out by the member countries.

Mandatory Requirements

According to the new regulations, there are mandatory requirements that apply to the products during the certification process. These requirements are included in the Unified List approved by the Customs Union Commission Decision № 620 dated on 07.04.2011. In order to work with the Unified List of products, it is needed to know the product description and import and export trade classification codes that used by the Customs Union.

A company must obtain the Certificate of Compliance with the Customs Union for the products in any of the member countries of the Customs Union, namely Russia, Belarus and Kazakhstan. Thus, the company that received the Certificate of Compliance with the Customs Union may import goods into the territory of Russia, Belarus and Kazakhstan.

The products that are not included in the Unified List are not subject to the mandatory requirements to comply with the Customs Union Regulations. However, the applicant has right to obtain any permitting documents on the products to comply with the Customs Union Regulations. This also applies to the products regardless of whether they are included in a Unified List or not.

Since the Customs Union Technical Regulations entered into the force the products automatically excluded from the Unified List on the territory of Customs Union member country.

The products that are subject to the mandatory compliance with the Unified List requirements and sold in the Customs Union member countries under the label established by the law of this country where the company plans to sell the products.

It is noteworthy that the validity period of the Certificate of Compliance for products issued using the standard form, according to the Customs Union Commission Decision № 563 dated on 02.03.2011 shall not exceed 5 years.

The certification authorities that included in the Unified Register of the Customs Union are responsible for issuing the standard Certificates and Declarations of Compliance. The order that includes the certification authorities in the Unified Register strictly regulated by the requirements, which approved by the Customs Union Commission Decision № 319 dated on 18.06.2010.
