Declaration of Compliance for the products in GOST R system

The Declaration of Compliance is an official document registered by the accredited certification authority that certifies the quality of products in compliance to the established standards.

Differences between the declaration of compliance and other certification documents

The Declaration of Compliance is an alternative to the mandatory certification particularly the difference is only in issuance of a document. The Declaration of Compliance filled out by the applicant (dealer or manufacturer) and registered by the accredited certification authority. The Declaration of Compliance issued for a period of 1 year up to 5 years.

Procedures to register the Declaration of Compliance and obtain the mandatory certificate regulated by the applicable regulations of the Russian Federation, namely Russian Standard Resolution N64 dated on July 30, 2002 as amended on 08.02.2006 stipulates to the following division:

• Product Code Listing is subject to the mandatory declaration

• Product Code Listing is subject to the mandatory certification

Registration of the Declarations of Compliance

According to the provisions of Article 24 of the Federal Law №184 "On Technical Regulations", dated on December 27, 2002, it is possible to issue the Declaration of Compliance directly to an importer and a manufacturer.

A foreign manufacturer cannot file for the Declaration of Compliance. In this case, there is available only a voluntary certificate for the products, however, it only confirms the product quality and cannot serve as a permitting document on the import and subsequent sale products in the territory of the Russian Federation.

Here are eligible applicants for the Declaration of Compliance:

• Business entities, private entities and individual entrepreneurs registered in the territory of the Russian Federation

• Product manufacturers registered in the territory of the Russian Federation or its dealers

• Russian representatives of foreign companies that have appropriate authority and act on the basis of contractual obligations, as well as they are responsible for the compliance of products with the Technical Regulations established by legal standards of the Russian Federation.

Declaration of Compliance has two types of registration:

• On a contract basis - the Declaration of Compliance includes a contract number under which the products will be imported.

• On a manufacturer - an authority issues the Declaration of Compliance to the manufacturer, as well as an authorized representative who represents interests of the manufacturer in the territory of the Russian Federation, there must be indicated a Russian company.

The Declaration of Compliance is valid throughout the territory of the Russian Federation.

Regulatory System

Registration of the Declarations of Compliance based on the standards and requirements according to the legislation of the Russian Federation, as well as provisions and amendments to the existing laws. Here are the main ones:

The Government Resolution of the Russian Federation №982 dated on 01.12.2009.

The list of products that is subject to the mandatory compliance with the customs clearance dated on 15.02.2010.

The Federal Law №184 "On Technical Regulations", dated on December 27, 2002.

The Declaration of Compliance for the products is subject to reissuing if the Technical Regulations had some changes or added by new standards.
